This Privacy Policy explains how we process personal data when you browse our website, place an order, manage a subscription, subscribe to promotional emails or contact us.

Our processing is subject to the Swiss Federal Act on Data Protection (FADP) and other applicable Swiss legal requirements.

2. Personal data we process

Depending on how you interact with us, we process:

  • Contact details, such as your name, email address, telephone number and billing and delivery addresses.
  • Order details, such as products purchased, amounts paid, delivery information, returns and refunds.
  • Payment-related information, such as your selected payment method, payment status and transaction references. Payment providers process the information required to complete your payment.
  • Customer account and subscription information, including your preferences, subscription status and scheduled orders.
  • Communications you send us, including enquiries and customer service requests.
  • Marketing preferences, including your subscription to promotional emails and any withdrawal of that subscription.
  • Technical and browsing information, such as your IP address, browser and device information, pages visited and interactions with our website.

We obtain this information directly from you, automatically through our website and from service providers involved in operating our store.

3. Why we process personal data

We process personal data to:

  • Receive and fulfil orders, process payments and arrange deliveries.
  • Manage customer accounts and coffee subscriptions.
  • Handle enquiries, cancellations, returns, refunds and complaints.
  • Send order confirmations, delivery updates and other service messages.
  • Send promotional emails in accordance with your preferences and applicable legal requirements.
  • Operate, secure and improve our website and understand how it is used.
  • Prevent fraud and misuse.
  • Meet our accounting and other legal obligations and establish, exercise or defend legal claims.

Where consent is required for a particular activity, we request it and allow you to withdraw it.

4. Shopify and our service providers

Our online store is hosted by Shopify. Shopify processes personal data to provide the ecommerce platform and related services, including checkout, customer accounts, subscriptions, communications, security and store analytics.

We also disclose the information necessary to fulfil your order to payment providers and Swiss Post. Other technical service providers may process information on our behalf to support the operation of our store.

We may disclose personal data to authorities where legally required or where necessary to establish, exercise or defend legal claims.

5. Shopify Network Intelligence

Shopify Network Intelligence is enabled for our store.

This allows Shopify to process information about interactions with our store together with information from interactions with other Shopify merchants and Shopify services. These features support activities such as personalisation, store improvements and more relevant advertising.

For certain purposes associated with these enhanced services, Shopify acts as an independent controller and is responsible for its own processing of personal data.

You can find further information about Shopify’s processing and available privacy choices here:

6. Promotional emails

We use Shopify Messaging to manage and send promotional emails, such as coffee news, product announcements and offers.

If you subscribe, we process your email address, marketing preferences and, where available, information about your interactions with our emails, such as clicks, to manage and assess our communications.

You can unsubscribe at any time using the unsubscribe link in our promotional emails or by contacting info@moacaffe.com.

Unsubscribing from promotional emails does not stop messages needed to manage your orders, payments or subscriptions.

7. Cookies and similar technologies

Our website uses cookies and similar technologies to operate the store, remember preferences, maintain your shopping cart and support security.

Depending on the features enabled, these technologies may also be used for analytics, personalisation and advertising, including Shopify’s enhanced services.

Where required, we ask for your consent before using the relevant technologies. Where a privacy preference tool is available on our website, you can use it to manage your choices.

You can also manage cookies through your browser settings. Blocking certain cookies may affect the operation of the store.

8. Processing outside Switzerland

Using Shopify and other service providers involves processing personal data outside Switzerland.

Our Shopify settings currently indicate the European Union as the data hosting region. This does not mean that all processing by Shopify and its service providers takes place exclusively within the European Union.

Where personal data is disclosed to a country without an adequate level of protection recognised under Swiss law, we use appropriate safeguards or an applicable legal exception. Safeguards may include recognised standard contractual clauses with the adaptations required for Switzerland.

You may contact us for further information about international disclosures and the safeguards applicable to your personal data.

9. How long we keep personal data

We keep personal data for as long as necessary for the purposes described in this policy.

Retention periods depend on the type of information, our relationship with you and applicable legal obligations. For example, relevant accounting records are generally retained for ten years.

We may retain certain information longer where necessary to resolve a dispute or meet a legal obligation. When information is no longer needed, we delete it or anonymise it.

10. Security

We use appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration and disclosure.

No website or method of electronic transmission can guarantee absolute security. Please avoid sending payment card details or other sensitive information by ordinary email.

11. Your rights

Subject to the conditions and limitations of Swiss law, you may:

  • Request information about whether we process personal data about you and obtain access to that data.
  • Request the correction of inaccurate personal data.
  • Request the deletion of personal data or object to processing where applicable.
  • Request the delivery or transfer of certain personal data in a commonly used electronic format where the statutory conditions are met.
  • Withdraw consent for processing based on consent, with effect for the future.
  • Unsubscribe from promotional emails at any time.

To make a request, contact info@moacaffe.com. We may need to verify your identity before responding.

Some information may need to be retained to comply with legal obligations or protect legitimate legal interests.

For processing for which Shopify is independently responsible, you can also use Shopify’s Privacy Portal.

12. Questions and concerns

If you have a question or concern about how we process personal data, please contact us at info@moacaffe.com.

13. Changes to this policy

We may update this Privacy Policy when our services, processing activities or legal requirements change.

The current version is published on this page with its last updated date. Where required, we will provide additional notice of significant changes.
